Did Central Florida's local governments take over SunRail by June 30, 2024, as promised?

Verdict: PENDING, OVERDUE, by about 2 years and 3 months (from June 30, 2024 to the last check on September 25, 2026: 2 years, 2 months and 26 days).

The promise has two parts, and they came out differently.
- Paying for SunRail: DELIVERED LATE, by six months. A 2024 agreement made December 31, 2024 "the final day of the FDOT Funding Period" [C13]. Since January 1, 2025, the five local governments have paid for running SunRail [C19, C20].
- Running and maintaining SunRail: PENDING, OVERDUE.
- FDOT still provides "management services in connection with the operation, management, and maintenance of SunRail" [C15].
- In June 2026 the local governments' commission agreed to keep paying FDOT to operate SunRail through its 2026-27 budget year [C34].
- Under the 2024 agreement, this arrangement ends "no later than December 31, 2027" [C16].
- The first two steps toward the hand-over were due December 31, 2025 [C17]. On December 4, 2025, the commission heard that one had not been started and the other would not be finished by then [C29, C30].
The promise
The Florida Department of Transportation (FDOT) wrote this in a SunRail scope of services [C7]:
"Local governments will assume the operations, maintenance, and the funding commitment afterwards. … The current expiration date of the Funding Period is June 30, 2024."
- When it was written. The document's own text carries no date. Its file is titled "Scope of Services Rev 11-18-21", and the PDF was created in January 2022 [C7b].
- The local governments are Orange, Osceola, Seminole and Volusia counties and the City of Orlando [C13]. They act together through the Central Florida Commuter Rail Commission ("the Commission") [C19].
- The Funding Period is the stretch in which FDOT pays SunRail's "operating deficits", the cost of running the trains beyond what they bring in [C2, C3].
Timeline
- 2007. On August 29, 2007, FDOT and the Commission entered into the original operating agreement [C1b]. Under it, FDOT would be "responsible for its funding, operation, management, and maintenance for a period seven years" after service began, and the Commission would take over after that [C1].
- 2010. An amendment took bond payments out of what FDOT covers in that period, leaving operating deficits. The Commission signed it on June 25, and FDOT on August 13, 2010 [C3, C3b].
- May 1, 2014. SunRail opened its first 32 miles, from DeBary to Sand Lake Road, with 12 stations [C4].
- October 29, 2020. Volusia County's representative on the Commission, Commissioner Kelley, said he understood Secretary Thibault of FDOT had stated "that on May 1, 2021 we will all be paying one way or another" [C5].
- February 4, 2021. Secretary Perdue of FDOT told the Commission that "the date will be extended until the completion of the Phase 2 North Project which is expected to be early to mid-2024" [C6]. Phase 2 North is the extension to DeLand [C21].
- Late 2021. FDOT's scope of services, in a file titled "Rev 11-18-21", gave June 30, 2024 as the end of the Funding Period. This is the promise [C7, C7b].
- 2022. The Commission's transition planning assumed the Funding Period would end in 2024, with operating contracts handed over "by June 30, 2024" [C8, C9].
- On August 4, Secretary Tyler of FDOT said "it remains the Department’s position to transition SunRail to the five Local Funding Partners" [C11].
- At the same meeting, the Commission's chair, Orlando Mayor Buddy Dyer, said FDOT "will not continue to operate SunRail" [C11].
- July 27, 2023. The Commission was still working on "coming to a consensus on the transition date with FDOT" [C12].
- November 16, 2023. A presentation to the Commission laid out a hand-over "in two Phases", with "Full Operating Control assumed by CFCRC within three years of transition of financial obligations" [C13a].
- March 28, 2024. The Operations Phasing Agreement between FDOT, the Commission and the five local governments took effect [C23]. Among other things, it:
- made December 31, 2024 "the final day of the FDOT Funding Period", the date the money would move [C13];
- had each local government pay its share from January 1, 2025 [C14];
- kept FDOT providing "management services in connection with the operation, management, and maintenance of SunRail" in the meantime [C15];
- set steps for the hand-over of operations, the first four due December 31, 2025, December 31, 2025, June 30, 2026 and December 31, 2026 [C17]. FDOT's role ends "no later than December 31, 2027" [C16];
- had FDOT pay the DeLand extension's operating cost for its first year of service, and $10,000,000 as its share of the trains' first overhauls [C14a].
- March 28, 2024 (same day). Mayor Dyer told the Commission: "FDOT will have operated it 10.5 years by the time it gets transitioned" [C13b].
- August 12, 2024. The Commission was told in July that service to DeLand would begin on this date [C21].
- December 2024. FDOT and the Commission signed the Locally Funded Agreement, the contract for the Commission's payments to FDOT for operating SunRail. Its amount is $65,344,339 [C22, C34].
- It says certain action steps in the phasing agreement "have been or will be revised or delayed to account for matters encountered during the transfer and transition process" [C23].
- December 31, 2024. $13,836,085 was transferred to FDOT under the phasing agreement. "Two days later, $10 million was transferred to the FDOT for the insurance piece of this exercise." [C18]
- January 1, 2025. The five local governments began paying for SunRail's operations [C19, C20].
- October 23, 2025. The Commission's final budget for 2025-26 was $73,478,598 [C27].
- November 5, 2025. An amendment to the payment contract was signed. It extends the contract "through the Interim Operating Period", because "the transition will extend beyond the initial term of the Agreement" [C28, C28b].
- December 4, 2025. At a Commission work session on the transition:
- The Commission's attorney, Stephanie Griffin Mateo, spoke about step 1, a term sheet (the outline of a deal) for an operating agreement with LYNX, the Central Florida Regional Transportation Authority, or another operator. She said: "We're not at the point where that process has been started." [C29, C17]
- She said step 2, the amendments to the 2007 operating agreement, "won't likely be completed by December 31" [C30].
- Osceola County Commissioner Viviana Janer said: "12/31/25, is not happening." [C30]
- FDOT's David Cooke said: "The Department recognizes where we are and that there will need to be some additional time to get there." [C31]
- April 23, 2026. The Commission's attorney presented recommendations for the Commission "as it transitions from an advisory board to an operating entity", starting with hiring an executive director [C33]. The minutes record no vote on the item [C33].
- June 25, 2026. The Commission approved a second amendment to the payment contract, to keep paying FDOT to operate SunRail under its 2026-27 budget [C34, C35].
- April to June 2026. The minutes of the April 23 and June 25 meetings record votes on other business [C33, C34, C37]. They record none on an operator term sheet, on the 2007 agreement's amendments, or on starting to hire contract operators (step 3, due June 30, 2026) [C33, C34, C17].
- September 17, 2026. The meeting agenda lists one action item, the reappointment of two members of the customer advisory committee [C36].
What changed, and why, in the record's own words
- 2021, Secretary Perdue of FDOT, as summarized in the minutes: "The initial date of transition was slated to be May of 2021. It is important to note that the construction of Phase 2 North is a key component that needs to be worked through in order for the transition to take place." [C6]
- 2022, Mayor Dyer, as summarized in the minutes: FDOT has "continued to operate the system past the seven-year time frame". [C11]
- 2024, Mayor Dyer: "SunRail was originally a mitigation project for the construction of the I-4 Ultimate and was supposed to operate during the construction of the I-4 Ultimate, which took a little longer than seven years." [C13b]
- 2024, the payment contract: certain action steps "have been or will be revised or delayed to account for matters encountered during the transfer and transition process". [C23]
- 2025, Mayor Dyer: he thanked FDOT for "taking on the additional burden of operating the system for it was supposed to be originally seven years and is now 11 years." [C26]
- 2025, FDOT's David Cooke: "there will need to be some additional time to get there." [C31]
What it costs
The documents give yearly figures. None of them states a total cost to the local governments.
- The payment contract, December 2024: $65,344,339 [C22].
- At the money hand-over: $13,836,085 on December 31, 2024, and $10 million for insurance two days later [C18].
- The Commission's 2025-26 budget: $73,478,598 in its final form [C27]. At the tentative stage, the local governments' share was $63,478,598, "$1.6 million greater than the $61.7 million estimated for FY26 and the LFA" [C25].
- The Commission's tentative 2026-27 budget: $74,272,334, within a total SunRail budget of $109,666,911 [C32]. The June 2026 amendment estimates that year's insurance premium at $5,400,000 [C35].
What to watch
- Step 3 (the Commission starts hiring contract operators) was due June 30, 2026 [C17].
- Step 4 (the operating agreement is signed) is due December 31, 2026 [C17].
- FDOT's interim role ends no later than December 31, 2027 [C16].
- Extensions. The agreement lets FDOT's District 5 Secretary extend a step assigned to the local governments or the Commission [C17]. FDOT's December 2025 statement about "additional time" was spoken. No written extension appears in the Commission's posted meeting packets from October 2025 to September 2026 [C31].
- Next check: the minutes of the September 17, 2026 meeting, which are not posted yet. The agenda gives the next meeting as October 22, 2026 [C36].
Limits
- Dates are the documents' own. Where a posted file's name carries a different date, this entry uses the date inside the document or the one a later contract recites. The 2007 agreement's posted file name carries 07.19.07, a date none of its pages carries [C1, C1b]. The 2010 amendment's file is named for the Commission's signing date [C3b].
- Statements that no vote was taken cover only the posted minutes named above. A decision recorded somewhere else would not show here.
