Verdict: PENDING, OVERDUE, by 1,487 days (counted from September 30, 2022 to the last check).
No record I read shows a final certificate of occupancy or an opening [C18, C22, C23]. The Town of Eatonville's own contract deadline, July 31, 2025, passed 452 days before the last check [C12].
Last checked: October 26, 2026.
- The promise. Spectrum News 13 reported on May 20, 2021 that "HostDime says construction on the data center should be complete by September 2022." [C11] HostDime's own groundbreaking release said "summer 2022" [C9].
- Where it stands. On August 18, 2026 HostDime's chief executive, Manny Vivar, told the town council: "We are pursuing the CO (Certificate of Occupancy) by the end of September." [C18] WFTV reported that at the September 15 council meeting, asked when it will be completed, he said "it'll be done when it's done", and "He declined to give another deadline" [C20, C22, C26]. The council packets for October 6 and October 20, 2026 carry no HostDime item [C23].
- The fine. Under the Town's second amendment HostDime "agrees to reimburse the Town $250.00 per day" after July 31, 2025 [C12]. At that rate, the 452 days through the last check come to $113,000. That is my arithmetic, not a record of what was billed or paid [C12]. Central Florida Public Media reported $99,250 as of September 1 [C21].
- Cost. HostDime's figure for the building went from "$30 million" to "$60 million" on the same web page, and the Town's September 2026 agenda cover says "$100 million" [C8, C8a, C19].
The promise
Spectrum News 13 reported the company's statement on the day after the groundbreaking [C11]:
"HostDime says construction on the data center should be complete by September 2022."
HostDime's own release from the groundbreaking gave a different month [C9]:
"Construction began early 2021 and is slated to be completed in summer 2022."
The Spectrum wording is the outlet's report of what the company said; the release is the company's own text. This entry counts from the later month, September 2022 [C9, C11].
Timeline
- 2016. The Town's Development Agreement with HostDime, dated May 26, 2016 [C5], has a Section 8 headed "Project Completion/Forced Sale" [C1]. It required HostDime to "receive a final certificate of occupancy for the Project and commence operations at the Project" "by June 30, 2019", with the date extended to June 30, 2020 if substantial work had begun [C1]. The Town agreed to reimburse up to $200,000 of water and sewer costs [C2]. HostDime's release dated May 31, 2016, as that page reads now, said "The 90,000 square-foot structure is projected to be complete by 2020." [C3]
- November 16, 2016. HostDime's ceremony release, as that page reads now, says the headquarters "will be completed in 2021" [C4]. I could not recover its original 2016 wording [C4].
- October 22, 2018. HostDime's release, as that page reads now, described the Eatonville headquarters as "to be completed in 2020" [C6].
- March 25, 2019. HostDime's release, as that page reads now, said the project had been "put on a brief hold due to construction cost increases" and that these increases "put the proposed project over budget" [C7].
- October 2020. The Town's first amendment says "the Town previously granted an extension of the Operations Start Date to October 28, 2020" [C5]. The second amendment gives October 29, 2020 for the same extension [C12].
- February 4, 2021. HostDime's release, as the Wayback Machine captured it on April 16, 2021, said "a new $30 million dollar, 95,000 square foot Orlando data center" and "Once the facility is finished in Q1 of 2022" [C8].
- May 19, 2021. HostDime's groundbreaking release, as that page reads now: "slated to be completed in summer 2022" [C9]. Spectrum's report followed on May 20 [C11].
- December 6, 2021. HostDime's release: "will be completed in Q4 2022" [C10].
- January 16, 2024. The Town's first amendment took effect: "The Operations Start Date shall be extended to June 30, 2024." [C5] The amendment is "Effective as of January 16, 2024" and recites that the Town Council voted on it "at a public meeting of the Town Council on January 16, 2024" [C5]. Amendment No. 2 refers to it as "Amendment No. 1 dated January 19, 2024" [C12]. The two documents give different dates for it: January 16 (vote and effective date) and January 19 (as Amendment No. 2 dates it).
- February 4, 2025. The Town's second amendment took effect: "The Operations Start Date shall be extended to July 31, 2025." [C12] It sets $250.00 a day after that date, and says the amount "shall be paid to the Town before issuance of the final certificate of occupancy", "unless any of the delay was caused by the Town" [C12]. It recites that "the Town has reimbursed HostDime $200,000.00 in accordance with Section 3(a)(i) of the Agreement" and that "the Town has not invoked the Forced Sale option contained in Section 8 of the Agreement" [C28].
- July 31, 2025. The Operations Start Date under the second amendment passed; the $250.00 a day runs after that date [C12].
- August 5, 2025. At the council meeting of that date, the Town's chief administrative officer, Demetrius Pressley, told council "they have not completed. As of July 31st, they are now being charged $250 per day." [C13]
- August 19, 2025. The council tabled a motion on extending the completion date; it passed 4 to 1 [C14]. The minutes record the mayor asking "that the $200,000 be returned to the town before considering an extension" [C29]. The draft third amendment would have moved the date to December 31, 2025 at "$500.00 per day" [C15].
- September 2, 2025. The council tabled the third amendment again [C16]. Asked what had to be finished to get the certificate of occupancy, Vivar listed the parking lot, "remaining site work", landscaping and the inside of the facility, and said "should be done by October" [C16].
- October 21, 2025. A council member asked "What is the completion date?" and another answered "I do not have that information." [C17]
- July 2026. HostDime's February 2021 release, at the same web address, now says "$60 million dollar, 100,000 square foot" and "Once the facility is finished in Q3 2025", and the page's own modified time is 2026-07-08 [C8a]. Nothing on the page says it was edited [C8a].
- August 18, 2026. Vivar's statement above [C18]. In answer to a council member's question about a stop work order he said "We were reinstated last year." [C18]
- September 2026. The Town's September 1 agenda cover lists "Discussion of HostDime and Review of the Previous Amendments in Consideration to an Amendments #3" and says "HostDime expects the building to fully open in Q3 2026." [C19] The council put off a decision on doubling the fine [C21]. A HostDime presentation was on the September 15 agenda [C20].
- At the last check. No HostDime item is in the October 6 or October 20 council packets, and no minutes are posted for any council meeting after August 18, 2026 [C23].
What changed and why, in the record's own words
- The completion date, in the company's words: "2020" (2016 and 2018 releases) [C3, C6], "2021" (2016 ceremony release as it reads now) [C4], "Q1 of 2022" [C8], "summer 2022" [C9], "Q4 2022" [C10], "Q3 2025" (the edited 2021 release) [C8a] and "Q3 2026" (the Town's agenda cover) [C19].
- The town's contract date moved from "June 30, 2019" to "June 30, 2020" under the agreement's own terms [C1], then to October 2020 [C5], "June 30, 2024" [C5] and "July 31, 2025" [C12]. A third amendment that would have set December 31, 2025 and $500 a day was tabled twice and has not been adopted [C14, C15, C16, C19].
- The reasons given in the record: HostDime's 2019 release cites "construction cost increases" [C7]. WFTV wrote in September 2026 that "The delays were caused by the pandemic and the demolition of the nearby Hungerford School Site, Vivar said." [C26] In the town's August 4, 2026 minutes Public Works says of HostDime's culvert, "The culvert was not built appropriately which is causing flooding (by HostDime)." [C17b]
- The Town's own cover misstates the first date. Its September 2026 cover says "Original Date: The project was initially scheduled for completion by July 31, 2025" [C19]. The 2016 agreement's date was "June 30, 2019" [C1].
What it cost
These are different measures from different dates. They do not add up to one total.
- Project cost, company figures. "$30 million" in the February 2021 release as captured in April 2021 [C8], and "$60 million" in the same release as it reads now [C8a].
- Project cost, other figures. The Town's September 2026 agenda cover calls it "the $100 million AI-ready facility" [C19]. Data Center Dynamics, citing the Orlando Business Journal in September 2025, reported "around $75 million to date", "up from previous estimates of $35 million" [C24].
- Public money. The Town agreed to reimburse up to $200,000 of water and sewer costs [C2]. Amendment No. 2 recites that it "has reimbursed HostDime $200,000.00" [C28]. The August 19, 2025 minutes record the mayor asking for that sum back before an extension [C29]. I found no record that it has been returned [C23, C29].
- The fine. $250.00 a day after July 31, 2025, payable "before issuance of the final certificate of occupancy", and reduced for days of delay the Town caused [C12]. CFPM reported $99,250 as of September 1, 2026 [C21]. I found no record that any of it has been paid or billed [C12, C23].
What to watch
- A final certificate of occupancy. The fine runs until one issues [C12]. Vivar said in August he was pursuing one by the end of September [C18].
- Minutes of the September 1 and September 15, 2026 council meetings, which are not posted [C23].
- Amendment No. 3. The cover lists it "in Consideration" [C19]. It has not been adopted [C14, C15, C16, C19].
- The Town's forced-sale option. Amendment No. 2 says the Town "has not invoked" it [C28]. I found no record after that of the Town invoking it [C23].
What this entry did not check
- Whether the building has a certificate of occupancy or has opened. I did not query the Town's building records or Orange County's permit system, and I did not see the building [C23].
- The Town's records before April 2025. The 2020 extension, the January 2024 vote and the February 2025 approval come only from the amendments' own recitals [C5, C12].
- Whether any of the fine has been paid or billed. I found no record either way [C12, C23].
- The stop work order Vivar mentioned: its date and cause are not in the records I read [C18].
- The first-published text of HostDime's May 2021 release and of its 2016 ceremony release [C4, C9].
- Quotes from the Development Agreement, both amendments and the council minutes come from scanned pages; each was compared with the page image before use [C1, C5, C12, C14, C16, C28, C29].
